This Personal Data Privacy Policy (hereinafter referred to as the Privacy Policy) applies to all information the Company may receive about the User while using the website www.freshlab.net.
1. TERMS AND DEFINITIONS1.1 The following terms and definitions are used in this Privacy Policy:
1.1.1. "Company" means Freshlab LLC, represented by authorized employees who, under their job descriptions and corporate responsibilities, have access to all data collected by the website www.freshlab.net.
1.1.2. "Personal data" means any information relating directly or indirectly to a specific or identifiable individual (personal data subject).
1.1.3. "Personal data processing" means any action (operation) or set of actions (operations) performed with the use of automation tools or without the use of such tools with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, changing), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.
1.1.5. "Personal data confidentiality" means a mandatory requirement for the Company or other person who has gained access to personal data, namely, to prevent their dissemination without the consent of the personal data subject or other legal basis.
1.1.6. "WEB-site www.freshlab.net" (hereinafter referred to as the "Website") means a web page located at
https://www.freshlab.net/1.1.8. "Service user" (hereinafter referred to as the "User") means a person who visits the Website and contacts the Company, leaving their personal data.
2. GENERAL PROVISIONS2.1. Use of the Website by the User means acceptance of this Privacy Policy and the terms of the User's personal data processing.
2.2. In case of disagreement with the terms of the Privacy Policy, the User must stop using the Website.
3. SUBJECT OF THE PRIVACY POLICY3.1. The Privacy Policy establishes the Company's obligations to not disclose and ensure the confidentiality of personal data that the User provides at the request of the Company when registering on the Website, placing an application or order for the purchase of goods and/or Services.
3.2. The personal data allowed to be processed under this Privacy Policy shall be provided by the User through filling out the registration forms on the Website and shall contain the following information:

3.2.3. e-mail address;
3.4. Any other personal information not specified above (purchase history, browsers and operating systems used, IP address, etc.) shall be subject to secure storage and non-disclosure, except as provided in clause 5.2. and 5.3. of this Privacy Policy.
4. PURPOSE OF COLLECTING USER'S PERSONAL DATA4.1. The Company may use the User's personal data for the following purposes:
4.1.1. Identifying the User registered on the Website for placing an order and/or concluding a Contract for the sale of goods remotely.
4.1.2. Providing the User with access to personalized resources of the Website.
4.1.3. Establishing communication with the User, including sending notifications, and requests regarding the use of the Website, rendering services, and processing requests and applications from the User.
4.1.4. Determining the approximate location of the User to ensure security and prevent fraud.
4.1.5. Verifying the accuracy and completeness of personal data provided by the User.
4.1.6. Creating an account for making purchases if the User has agreed to create an account.
4.1.7. Notifying the User about the status of the Order and/or the User's Personal Account.
4.1.8. Processing and receiving payments, confirming tax or tax benefits, denying payment, and determining the User's eligibility for a credit line.
4.1.9. Providing the User with prompt customer and technical support in case of problems related to the use of the Website.
4.1.10. Providing the User with product updates, special offers, pricing information, newsletters, and other information on behalf of the Company with their consent.
4.1.11. Conducting advertising activities with the consent of the User.
5. METHODS AND TERMS OF PERSONAL DATA PROCESSING5.1. The User's personal data may be processed without any time limit, in any legal way, including in personal data information systems with or without the use of automation tools.
5.2. The User agrees that the Company has the right to transfer personal data to third parties, in particular, courier services, postal organizations, and telecommunications operators, solely to fulfill the User's order placed on the Website, including the delivery of the Goods.
5.3. The User's personal data may be transferred to the authorized state authorities of Ukraine only on the grounds and in the manner prescribed by the legislation of Ukraine.
5.4. In case of loss or disclosure of personal data, the Company informs the User about the loss or disclosure of personal data.
5.5. The providers shall take the necessary organizational and technical measures to protect the User's personal data from unauthorized or accidental access, destruction, modification, blocking, copying, and distribution, as well as from other illegal actions of third parties.
5.6. The providers, together with the User, take all necessary measures to prevent damages or other negative consequences caused by the loss or disclosure of the User's personal data.
6. OBLIGATIONS OF THE PARTIES6.1. The User shall be obliged to:6.1.1. Provide information about personal data necessary to use the Website.
6.1.2. Update, supplement the provided information about personal data in case of changes in this information.
6.2. The Company shall be obliged to:6.2.1. Use the information received solely for the purposes specified in Section 4 of this Privacy Policy.
6.2.2. Ensure that confidential information is kept secret, not disclosed without the prior written consent of the User, and not to sell, exchange, publish, or disclose in any other way the provided personal data of the User, except for clause 5.2. and 5.3. of this Privacy Policy.
6.2.3. Take precautions to protect the confidentiality of the User's personal data following the procedure commonly used to protect this type of information in the existing business environment.
6.2.4. Block personal data related to the relevant User from the moment of contact or request of the User or their legal representative or authorized body for the protection of the rights of personal data subjects for the period of verification, in case of revealing false personal data or illegal actions.
7. LIABILITY OF THE PARTIES7.1. In case of failure to fulfill its obligations, the Company shall be liable for losses incurred by the User in connection with the misuse of personal data under the legislation of Ukraine, except as provided for in clause 5.2., 5.3. and 7.2. of this Privacy Policy.
7.2. In the event of loss or disclosure of Confidential Information, the Company shall not be liable if such confidential information:
7.2.1. Became public domain before its loss or disclosure.
7.2.2. Was received from a third party prior to its receipt by the Company.
7.2.3. Was disclosed with the consent of the User.
8. SETTLEMENT OF DISPUTES8.1. Prior to filing a lawsuit in disputes arising from the relationship between the User and the Company, it is mandatory to submit a claim (written proposal for voluntary settlement of the dispute).
8.2. The recipient of the claim within 30 calendar days from the date of receipt of the claim, notifies the claimant in writing of the results of the claim.
8.3. If no agreement is reached, the dispute will be submitted to a judicial body in accordance with the current legislation of Ukraine.
8.4. The current legislation of Ukraine applies to this Privacy and Relationship Policy between the User and the Company.
9. ADDITIONAL TERMS AND CONDITIONS9.1. The Company shall have the right to amend this Privacy Policy.
9.2. A new Privacy Policy shall become effective from the moment it is posted on the Website unless otherwise provided by the new version of the Privacy Policy.
9.3. All suggestions or questions regarding this Privacy Policy shall be communicated to the Company using the contacts indicated on the Website.
